To achieve the orderly development of the certification and accreditation industry, China has established the certification and accreditation laws and regulations system which is centered on the Regulations of the People’s Republic of China on Certification and Accreditation, with administrative regulations closely linked with technical regulations. The certification and accreditation laws and regulations system, based on the Regulations on Certification and Accreditation, is divided into four levels (as shown in Figure 2):

 

The first level is composed of laws, mainly including: the Law of the People’s Republic of China on Product Quality, the Law of the People’s Republic of China on Import and Export Commodity Inspection, Metrology Law of the People’s Republic of ChinaFood Safety Law of the People’s Republic of China, and other current effective certification and accreditation related laws, 19 in total;

 

The second level is composed of administrative regulations, including the Regulations on Certification and Accreditation, the Regulations on the Implementation of the Law of the People’s Republic of China on Import and Export Commodity Inspection, the Rules for the Implementation of the Metrology Law of the People’s Republic of China, the Regulations on the Supervision and Administration of Medical Devices, and others, 17 in total;

 

The third level is composed of department regulations, including the Provisions on the Administration of Compulsory Product Certification, the Measures for Administration of Energy Efficiency Labels, and Provisions on the Supervision and Administration of Fire Prevention Products, among others for a total of 41;

 

The fourth level is composed of administrative normative documents, including the Administrative Measures for Compulsory Product Certification Mark, the Measures for Implementation of Laboratory Proficiency Test, the Measures for Appeal and Settlement of Complaints in Certification and Accreditation, and others, 29 in total.
